Thanks for shopping with Rent The Baby Gear. Our mission is to make your vacation with your little one as stress free as possible. Here are a few things you need to know and agree to if you would like to rent with us.

By renting from Rent The Baby Gear, you accept the following terms and conditions.  These terms and conditions are governed by digitally printing your name.

  1. Your baby’s safety. Your baby’s safety is of paramount importance to us. That’s why we carry some of the most highly-rated baby equipment currently made.  Our founder is the father of two small boys.  He started Rent The Baby Gear because he saw a need in the marketplace and wanted to provide a high quality rental service to other parents who traveled with their children.  At Rent The Baby Gear we endeavor to inspect every piece of equipment before we ship it to ensure that it is in good working condition and all components are included.  We regularly purchase new items and dispose of older ones to keep our inventory in good working order.  Despite our efforts, our care of our products cannot replace your vigilance and oversight of your child/ren and the objects they come into contact with while traveling with you.  Given this, Rent The Baby Gear is not responsible for any harm that comes to your child while traveling with you whether or not it happens while using equipment you rent from us. Please inspect all equipment you receive from us upon receipt and contact us immediately if you see something is amiss or a part is missing.  Your satisfaction and child’s safety is our top priority.
  2. Return gear in the same condition you received it. We strive to send you baby gear in good, clean condition and we ask that you return it to us in the same condition. If equipment is not returned to us or comes back broken, damaged, dirty, soiled or wet, we will charge you for repair, replacement or cleaning. Charges can range from $15 for cleaning up to the full replacement cost of the equipment (plus a $25 administrative/worker charge).
  3. Return gear in the same or same size box. We keep our costs affordable via our customized UPS ground shipping methods. In order to do this we require that you return your equipment in the same box and same manner in which it was shipped to you. If you use a larger box or do not repack your box with items folded/allocated properly, making the box size larger than how it arrived to you, UPS charges us a considerably larger sum of money for the return. Should you lose your box, throw it away, etc. and return the gear in a larger box or in the same box but packed so the box is bulging, we will charge you for the full price of the return. This cost can be costly (upwards of $50) so please do keep the original boxing and repack your box as the rental arrived to you or return your rental in the same size box in which we shipped it.
  4. Return all your gear & manuals. Sometimes our rentals contain smaller pieces that go along with the main item (sheets, attachments, straps, etc). If you do not return all the items when you ship your rental back to us, we will have to charge you for what’s missing, plus a $25 administrative/worker fee. Sometimes that means buying a whole new item (in cases where just the missing piece can’t be purchased separately), in which case we will have to charge you for the whole item replacement cost.
  5. Return your gear via UPS within 1 business day of rental period expiration. If UPS has not received your returned items within 1 business day of the end of your rental period you will be charged for the days we are missing the item from our inventory rounded up to a week. (For example, if your rental ends on a Sunday and you do not return your item to UPS (via drop off or pick up) until Tuesday, we will charge you for an additional week of rental.
  6. Cancelations.  Rent The Baby Gear is happy to cancel your order before it is in the possession of UPS – free of charge.  However, if your order is already in the possession of UPS (but has not yet been shipped) we will charge you a $25 administrative/worker charge to cancel order.  Generally, UPS is not in possession of your package until the morning of the scheduled shipping date.  Depending on your delivery location, the shipping date may be between 1-4 days before you scheduled delivery of your package.  If your package is already in transit when you cancel, you will be charged the full price of the rental and will be responsible for returning the package to us using the enclosed UPS shipping label within one day of the last day of the rental period. Any additional costs that arise from not canceling your order before it has shipped will be your full responsibility, and where appropriate, an additional $25 administrative fee will be charged to your credit card.
  7. UPS Store Drop Off vs. UPS Doorstep Pickup.
    • At the time you place your order you will be required to choose a rental return method.  If you choose “UPS Store Drop Off” you will be required to drop off your rental/s to a nearby UPS Store location in the same or same size box in which it was delivered to you, using the UPS return shipping label we enclosed with your rental when we shipped it to you. This return method is free of charge to you as long as your item is in good condition and in the same size box you received it.
    • If you choose “UPS Doorstep Pickup” at checkout, your return will consist of you placing your rental item/s in the same or same size box it was delivered to you, affixing the UPS return shipping label we enclosed with your rental when we shipped it to you, and UPS will pick it up from your delivery address on the last day of your rental.  A $15 pickup fee will be charged to your card at the time you place your order.
    • If you opted for “UPS Doorstep Pickup” at the time you placed your order, but then change your mind (whether it’s 1 minute after you place your order or several days after) we cannot refund the $15 UPS Pickup fee to you.  However, we will gladly issue a $15 credit toward your next order with us.  Please call or email us if this is the case and we will arrange the cancelation of the pickup and your $15 credit.
    • If you opted for “UPS Store Drop Off” when you placed your order but then decide you would like UPS Doorstep Pickup, we can accommodate your request, but you will have to pay the $15 pickup fee via our PayPal account at bill@rentthebabygear.com.  Once we have received your $15 payment, we will coordinate with you about pickup address and time and then schedule a pickup for you.
  8. Rentals that begin or end on a government holiday, Saturday or Sunday. UPS Ground does not deliver on government holidays, Saturdays and Sundays. If you require a rental to begin on one of these days, please schedule delivery of your order for a preceding business day to assure it is waiting for you on the required day.  If your rental period ends on a government holiday, Saturday or Sunday, please make sure to drop off your box for return at a nearby UPS location on the next business day or schedule your UPS Pickup for the next business day.  (Please note, in some cases UPS Stores are open on Saturdays in which case you can drop off your return and it will be shipped out the next business day).  Rent The Baby Gear will not take responsibility for items you cannot return due to government holidays, Saturdays and Sundays and expects you to plan your delivery and return accordingly.  If you find that you have not planned for a government holiday, Saturday and/or Sunday start/end date for your rental, we will assist you as much as we are able, but any additional costs that arise will be your responsibility.
  9. Rental delivery. Rent The Baby Gear currently ships all its rentals via UPS Ground (with the exception of rentals in the Kansas City, MO metro area which are delivered by us directly).UPS Ground allows us to keep our pricing affordable and convenient for our customers, but it does occasionally come with risks. Please read the following risks and take the necessary steps to assure rental delivery on the date and time you require it:
    • UPS failure to deliver on date specified. Although your package will be designated as requiring no signature upon delivery, UPS drivers at their sole discretion may deem that it is unsafe to leave the package at your doorstep. When this happens they will leave a slip at your delivery location stating they will redeliver the package on the next business day. If this is not convenient for you, you may call the local UPS location (contact information will be on the slip) and schedule a time you will pick up the package at their facility.
      1. In order to be sure that your package is delivered on the day you choose, it is best to have it delivered to a hotel, business or residence where someone is present to accept the delivery. If this is not possible, please leave a note for UPS on the door letting driver know that they can leave the package on your doorstep or some other place at the address where they should leave the rental. If you cannot be there to leave a note for UPS, have someone else do it for you.
      2. In most cases leaving a note to ensure delivery of your rental via UPS Ground is not required, however, if the UPS driver decides not to leave the package because someone is not present to accept the package, they do not see a note, or do not feel it is safe to do so, then this lapse in delivery is not the responsibility of Rent The Baby Gear.
    • UPS failure to deliver at the hour you require. UPS guarantees delivery of its packages before 8pm. Usually it delivers in the early-to-mid afternoon. However, if you require that a rental arrive before that time, please schedule a delivery for the day before to be certain you have it before you require it.
    • UPS failure to leave package in special drop off location at your specified address – In the past customers have made special requests on their orders for UPS to drop off their package “in the shed” or “under the awning to the right of the house” etc at their delivery address.  In all instances we do pass along these requests to UPS.  However, we have found that UPS drivers do not always receive or follow these instructions when they originate from the sender.  Rent the Baby Gear can not take responsibility for packages that are left for you by UPS but not in the special location you requested at the time you placed your order.  In order to assure that your package is left in a special spot at your delivery address, please leave a clearly labeled note for the UPS delivery truck in a prominent location (your doorstep is the safest bet) that they are sure to see.  We have found that UPS is more likely to drop the package in a spot that is not your doorstep if they see a special request note at the time they are dropping the package off.
    • Government holidays, Saturdays and Sundays. UPS Ground does not deliver on government holidays, Saturdays or Sundays. If you require a rental to arrive on a government holiday, Saturday or Sunday, please schedule your delivery for a preceding business day.

Other UPS-related information

    1. If your tracking number says the driver completed the delivery, then the package’s tracking status or a delivery notice (a UPS InfoNotice® ) should indicate where your driver left the package. Shipments that don’t require a signature can be left in a safe place at the driver’s discretion. This could include the front porch, side door, back porch, or garage area.
    2. If the tracking status indicates that your driver completed delivery and obtained a signature, the package might have been signed for by a neighbor or another resident at your location. If the driver delivered your shipment to an alternate location, you should have received a UPS InfoNotice that indicates where the shipment was left (for example, a neighbor’s house or leasing office).
    3. If the tracking status indicates that your driver completed delivery but you cannot find the package, check with others at your address, or perhaps a neighbor, to see if someone else has picked up the package. You can also check around the entrances of your residence for the package, particularly on back porches, bushes, garages, grills, or other places that might protect your package from theft or weather. Note that drivers may also use plastic bags to protect your package from the weather.
    4. If you still cannot locate the package, contact us at Rent The Baby Gear to initiate a trace process with UPS. We will then follow up with you on the progress of your shipment

Thank you for visiting RentTheBabyGear.com™ web site (the “Site”). The Site is designed to provide a convenient, private and informative shopping experience for consumers to rent baby equipment. By using the Site you agree to be bound by the terms set forth herein. We may make changes to the Site, these Terms of Use, or the policies and conditions that govern the use of the Site at any time. We encourage you to review the Site and these terms periodically for any updates or changes. Your continued access or use of the Site shall be deemed your acceptance of these changes and the reasonableness of these standards for notice of changes.

Electronic Communications

When you visit the Site or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. All other trademarks, product names, and company names and logos appearing on the Site are the property of their respective owners.

Your Account Obligations

In consideration of your use of the Site, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the checkout form for your account information (the “Account Information”) and (b) maintain and promptly update the Account Information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may suspend or terminate your account and refuse any and all current and future use of the Site.

You will receive a password and account designation when you have completed the Account Information. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to immediately notify us of any unauthorized use of your password or account or any other breach of security.

Your Conduct

Any conduct by you that in our sole discretion restricts or inhibits any other user from using or enjoying the Site will not be permitted. You agree to use the Site only for lawful purposes. You are prohibited from posting on or transmitting through the Site any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, fraudulent, racially, ethnically, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law.

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Site, use of the Site, or access to the Site.

You agree not to access the Site by any means other than through the interface that is provided by us for use in accessing the Site.

You acknowledge that the Site contains information, data, software, photographs, graphics, videos, text, images, typefaces, sounds, and other material (collectively “Content”) that are protected by copyrights, trademarks, or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or hereinafter developed. All Content is copyrighted as a collective work under the U.S. copyright laws. You may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the Content, in whole or in part. If no specific restrictions are displayed, you may make copies of select portions of the Content, provided that the copies are made only for your personal, information and non-commercial use and that you do not alter or modify the Content in any way, and maintain any notices contained in the Content, such as all copyright notices, trademark legends, or other proprietary rights notices. Color/Product Description

We have made every effort to display as accurately as possible the colors of our products that appear at the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate. We have attempted to be as accurate as possible. However, we do not warrant that the product descriptions are accurate, complete, reliable, current, or error-free. If a product offered by the Site is not as described, your sole remedy is to return it in unused condition.

Limitation of Liability 

UNDER NO CIRCUMSTANCES SHALL WE OR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DISTRIBUTING THE SITE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES FOR LOSS OF PROFITS, GOOD WILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) THAT RESULT FROM (i) THE USE OF OR INABILITY TO USE THE SITE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SITE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE. Export

The U.S. export control laws regulate the export and re-export of technology originating in the United States. This includes the electronic transmission of information and software to foreign countries and to certain foreign nationals. You agree to abide by these laws and their regulations – including but not limited to the Export Administration Act and the Arms Export Control Act and not to transfer, by electronic transmission or otherwise, any Content derived from the Site to either a foreign national or a foreign destination in violation of such laws.

Our Rights

Because customer service is paramount to our business, we reserve the right to refuse to sell products to you if it reasonably appears to us that you intend to resell the products. In addition, we reserve the right to limit quantities of items purchased by each customer. In addition, we reserve the right to cancel any order or part of an order, or refuse service to anyone for any reason. Such reasons may include, but are not limited to, unauthorized coupon use, product availability, price discrepancy or pricing error. We reserve the right to charge fees or extra shipping charges for any product that is backordered. We also reserve the right to change the terms of any offer or promotion at any time without notice. The posting of prices on our site is not an offer for sale of goods, and the order confirmation is not an acceptance of an offer to purchase goods. We cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mispriced. If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. The contract for sale of goods between us and any customer is not entered into until we charge a valid credit card or otherwise accept payment.

Submissions

We are pleased to hear from our customers and welcome your comments regarding our products and the Site. You may post or submit reviews of products or services, comments, suggestions, or other material (“Submissions”) as long as the content of your Submission is not unlawful, threatening, abusive, spiteful, defamatory, invasive of privacy, obscene, profane, sexually explicit, fraudulent or otherwise objectionable or injurious to third parties (including, but not limited to, any content that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate applicable law). You also grant Rent The Baby Gear and its subsidiaries the right to use the name you post in connection with such Submission.

By posting or sending us a Submission, you represent and warrant that you own or otherwise control all of the rights to the content in your Submission, that the content you provide is accurate, and that use of the content in your Submission does not violate this policy and will not cause injury to any person or entity. You agree to indemnify us against all claims and liabilities resulting from your Submission. We do not take any responsibility and assumes no liability for any Submission posted by you or any other person or entity.

Applicable Law

We control the Site from our offices within the United States of America. We make no representation that the Content in the Site is appropriate or available for use in other locations, and access to them from territories where their content is illegal is prohibited. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws. You may not use or export the Content in violation of U.S. export laws and regulations. Any claim relating to the Site, the services provided through the Site or the Content shall be governed by the internal laws of the state of Washington, without reference to its choice of law provisions.

Termination

These terms are effective until terminated by either party. If you no longer agree to be bound by the Terms of Use, you must cease your use of the Site. Subject to applicable law, we reserve the right to suspend or deny, in our sole discretion, your access to all or any portion of the Site with or without notice. You agree that any termination of your access to the Site may be effected without prior notice, and acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and bar any further access to such files or the Site. Further, you agree that we shall not be liable to you or any third-party for any termination of your access to the Site.

Customs Fees & VAT

If there are customs fees and VAT, they must be paid by you when the package reaches your destination country. Rent The Baby Gear is not responsible for any sales taxes, VAT, customs duties or other taxes charged by your customs department. These charges are your responsibility and will vary from country to country.

We cannot determine these fees in advance. We recommend that you check with your local customs office or post office for details on how these charges are assessed and applied. You may also be able to find information about your country’s VAT and Customs fees by searching websites on the Internet such as the United States Council for International Business. Please note that if your order has reached your country of destination and it is returned to us as Unclaimed or Refused due to VAT or customs fees imposed by your country, it can often take up to 6 months for us to receive, and we must receive the order back before we can issue you a refund.

General Information

These Terms of Use constitute the entire agreement between us (you and us) and govern the use of the Site. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. Our failure to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms of Use remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Site or the Terms of Use must be filed within one year after such claim or cause of action arose or be forever barred.
